Individual work schedule

The employee and the employer can agree on an individual working time regime, by establishing a personal work schedule for a particular employee. The employer may establish such schedules for one or several employees (group thereof), or all employees in the workplace.

When establishing an individual work schedule, it is important to ensure that the working time norm* is met during the working day (shift), week, month or other accounting period, which may not exceed three consecutive months.

Example: The employee is assigned a 4-day working week from Tuesday to Friday, by working 10 hours per day.

An individual work schedule differs from a flexible work schedule in that, when an individual work schedule is established, the employee must work according to a fixed schedule. Whereas in the case of a flexible work schedule, the employee has the right to change the start and/or end of his/her working day (shift) at his/her own discretion.

If an employee’s request to work under an individual work schedule is based on the employee’s wish to balance his/her work and family responsibilities, the employer may refuse to comply with this request only for important, objective reasons.

*An employee’s working time norm is 40 hours per week, unless the labour law norms establish a reduced working time norm for the employee, or the parties agree on part-time work.
